Article 1 Scope of Application

These Terms and Conditions apply to the use of the online shop operated by HOUSE OF HUNTER Co., Ltd. (hereinafter referred to as the "Service") and to users of the Service, including our company and the Members defined in Article 5 (hereinafter collectively referred to as the "Users, etc.").

Article 2 Changes to Terms of Use

  1. The Company may change these Terms of Use without individual agreement with Users, etc., when such changes are generally applicable to Users, etc., or when the Company determines that such changes are not contrary to the purpose of these Terms of Use and are reasonable in light of the circumstances pertaining to the changes.

  4. The Terms and Conditions amended under Paragraph 2 shall come into effect from the time they are displayed on websites operated by the Company, unless otherwise specified by the Company.
  5. The history of changes to these Terms and Conditions can be viewed on the Service.

Article 3 Use of the Service

  1. Users shall use the Service in accordance with these Terms and Conditions and the individual terms and conditions set out in the next article.
  2. The Company may change the content of the Service without individual agreement with the User, etc. Even if a Member incurs disadvantage or damage due to the change, the Company shall not be held responsible, except in cases of willful misconduct, gross negligence, or violation of the Consumer Contract Act.

Article 4 Relationship with Individual Terms, etc.

  1. In addition to these Terms, Users must also comply with any individual terms and conditions (regardless of their name, hereinafter referred to as the "Individual Terms, etc." and these Terms and Conditions are collectively referred to as the "Terms, etc.") established for individual services provided by the Company within the Service or in conjunction with the Service, in the same manner as these Terms and Conditions.
  2. In the event of any discrepancy between the provisions of these Terms and Conditions and those of any individual terms and conditions, the provisions of the individual terms and conditions shall take precedence unless otherwise specified in the individual terms and conditions.

Article 5 Membership

"Member" means a person who agrees to comply with these terms and conditions and registers as a member through the procedures specified by the Company.

"(a)" refers to a person who has applied for and been accepted by our company.

Article 6 Changes to Registration Information

If there are any changes to the name, address, telephone number, date of birth, credit card number and expiration date, or any other information registered at the time of membership registration, the Member must promptly notify the Company of the changes in the prescribed manner.

Article 7 Prohibition of Transfer of Membership Status, etc.

A Member may not transfer, buy or sell to a third party, or pledge or use as security, his/her status as a Member or the rights arising from these Terms and Conditions.

Article 8 Withdrawal

  1. A Member may cancel his/her membership to the Service by following the designated cancellation procedure.
  2. Membership status is personal, and the procedure set out in the preceding paragraph shall be deemed to have taken place at the time the Company becomes aware of the death of the Member in question.

Article 9 Prohibited Matters

  1. If a Member falls under any of the following items, the Company may immediately cancel the Member's membership without prior notice.

    (1) If you violate laws, regulations, or these Terms and Conditions

    (2) If a member commits any act within the Service that causes harm or offense to other members or other third parties, such as libel, defamation, or violation of privacy.

    (3) When engaging in election campaigning or similar activities

    (4) When business activities or profit-making activities are carried out

    (5) If you interfere with the operation of this service

    (6) If the Member violates the terms and conditions set by the connection provider with which the Member has a contract.

    (7) In addition to the acts set forth in Article 12, unauthorized use of 1D and password is confirmed.

    (8) If you provide false information to the Company (including the details of your membership registration)

    (9) If the credit card registered by the Member as a payment method is suspended.

    (10) If there is a default on payment obligations, such as fees.

    (11) If it becomes impossible to promptly contact the registered member information (address, telephone number, email address)

    (12) If the Member is a member of an organized crime group or has a close relationship with an organized crime group or a member of an organized crime group.

    (13) Any other case in which the Company determines that the Member is inappropriate as a Member.

  2. If a Member is unable to use the Service as a result of the Company cancelling the Member's membership in accordance with the preceding paragraph, the Company shall not be liable for any damage suffered by the Member or a third party as a result.

Article 10 Facilities, etc.

The Member shall, at his/her own expense and responsibility, prepare the necessary communication equipment, software and all other associated equipment required to use the Service, enter into a line usage contract, subscribe to an Internet connection service, and make other necessary preparations.

Article 11 Use of the Service

Members shall be responsible for all actions taken using the Service and the results thereof.

Article 12 Use of the Service

  1. Members must properly manage the ID and password that the Company will provide to them after they register as members.
  2. Members may not share their 1D and password with any third party, and may not lend or transfer them to any third party.
  3. If a Member forgets his/her 1D or password, he/she shall follow the procedures specified by the Company.
  4. If a Member's ID and password are stolen, or if the Member discovers that his/her ID and password have been used by a third party, the Member shall immediately notify the Company of this fact and follow any instructions given by the Company.

Article 13 Copyright, etc.

  1. Members may not use the copyrighted material provided through this service for purposes other than personal use.
  2. When a Member publishes a work on the Service, the Member grants the Company a license to use the work free of charge within the scope of the use on the Service or the purpose of introducing the Service (not including the rights stipulated in Articles 27 and 28 of the Copyright Act), and the Member will not exercise any moral rights of the author in relation to such use.

Article 14 Suspension or Cessation of Service Provision

  1. The Company reserves the right to take necessary measures, such as suspending or ceasing provision of all or part of the Service, without prior notice, when conducting regular or emergency maintenance of the system, when there is a concentrated load on the system, when the Company determines that operation of the Service is being impeded, when it becomes necessary to ensure the security of Members, or when the Company otherwise deems it necessary.
  2. The Company shall not be liable for any damages incurred by a Member as a result of the interruption or cessation of provision of the Service under the preceding paragraph, unless such damages are caused by the Company's willful misconduct, gross negligence, or violation of the Consumer Contract Act.

Article 15 Formation of contract, transfer of ownership and risk

  1. When a member orders a product through this service, the Company will send an email stating that the order has been received and stating the details of the order. An order from a member is an application for a contract to purchase a product, and when the above email is sent to the member, the member's application for a contract is accepted and the contract is established.
  2. When the Company delivers the product to the delivery company, the ownership and risk of the product shall be transferred to the Member. However, if the product is lost due to the intention or negligence of the delivery company before it arrives at the designated delivery address, the Company shall be liable for such loss.
  3. If there are any special instructions when ordering individual products that differ from the preceding two paragraphs, those instructions shall take precedence.

Article 16 Handling of Personal Information

Members agree that the Company will take all necessary protective measures regarding their personal information (meaning personal information as defined in Article 2, Paragraph 1 of the Personal Information Protection Act) and handle it as set forth in the following items.

(1) Acquisition of the following personal information by the Company

  6. Credit card number and expiration date
  7. Other information registered at the time of membership registration
  8. Product purchase history

(2) Use of personal information by our company for the following purposes:

  3. To send product information, lifestyle information, after-sales service, various special offers, etc. via email and postal mail from our company
  4. Requests for opinions, feedback, surveys, etc.
  5. Marketing and purchasing behavior analysis
  6. Provision of personal information to joint users (meaning "parties who jointly use the information" as defined in Article 23, Paragraph 4, Item 3 of the Personal Information Protection Law) within the scope of the above-mentioned purposes of use, and use of the personal information by joint users within the scope of the same purposes of use

Article 17 Disclosure, correction, deletion, etc. of personal information

  3. Members can correct or delete their personal information (excluding product purchase history) by changing their membership details.
  4. If a Member does not wish to receive email or postal mail from the Company, the Member may change his/her membership details to this setting. However, if the Company needs to contact the Member urgently, the Company may contact the Member regardless of the setting.
  5. Regarding the disclosure, correction, deletion, etc. of personal information not specified in this Article, in accordance with the provisions of Article 25 and following of the Personal Information Protection Act, requests for disclosure, etc. should be made to the contact details set out in Paragraph 2 of this Article.

Article 18 Governing Law

The establishment, validity, performance and interpretation of these Terms and Conditions shall be governed by the laws of Japan.

Article 19 Good faith consultation and exclusive jurisdiction

  1. If a dispute arises between a Member and our company in relation to these Terms and Conditions, the two parties shall cooperate in good faith to resolve the dispute.

  2. If the matter remains unresolved despite the consultation under the preceding paragraph, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
